This contract is between Pet Perfect Bengals LLC, hereinafter referred to as PPB, and Purchaser, hereinafter referred to as Purchaser. This contract is not transferable to any other party. This contract concerns Bengal, hereinafter referred to as Bengal.

2. Terms of Service and Conditions

_______All payments are Non-Refundable at all times except for what is outlined in this contract because they are required to maintain and upkeep PPB Cattery as well as to preserve the seriousness of purchasing Bengal. The Reservation Payment for Bengal is non-transferable but will guarantee the hold on Bengal. Only if Bengal becomes unfit for sale will the Reservation Payment be put towards another cat/kitten. If for any reason Purchaser is unable or unwilling to purchase Bengal, no refund or other compensation will be paid. PPB reserves the right to cancel this sale at any time prior to Bengal leaving PPB’s residence if PPB feels that it is in the best interest of Bengal and/or PPB. In that instance, Purchaser will be refunded 100% of the purchase price. Bengal is the sole property of PPB and should be considered as such until Bengal is in Purchaser’s possession.

_______Dispute Resolution

Both parties agree that any disputes shall be resolved privately. Issues shall not be aired in public forums including, but not limited to; Yahoo Group, Facebook, Instagram, Reddit, Yelp, or any other social media platform. This includes the use of the parties’ dispute as examples of hypothetical situations, or as examples of possible disputes in these public forums. Any violation of this clause by either party shall result in a penalty of $5,000.

_______Severability & Jurisdiction

If any provision of this contract is deemed to be invalid or unenforceable, it does not invalidate the enforceability of any other provision, clause, or conditions set forth in the remainder of this contract. PPB’s failure to enforce any event of breach of this contract shall not constitute consent to any breach or waiver of PPB’s rights to enforce any other breach of contract. If any clause of this contract is invalid or illegible or unenforceable, the rest is enforceable. If any litigation occurs as a result of this contract by Purchaser or PPB, it is understood that all such legal action shall be filed and performed in PPB’s current County and State of residence, United States of America, regardless of the Purchaser’s place of residence. Purchaser agrees that any judgments made are enforceable within Purchaser’s jurisdiction as if obtained within that jurisdiction. Purchaser agrees that if any legal action needs to be taken that all legal fees will be Purchaser’s responsibility for both parties.

If this contract is breached in any way, the Purchaser will owe PPB a fee of $1,000 USD for breach of contract, each and every time the contract is breached. Once the contract is breached, Purchaser is to surrender Bengal back to PPB without refund and at Purchaser’s expense with a signed Transfer of Ownership.

_______Limits of Liability

PPB’s limit of liability shall at no point exceed the purchase price of the Bengal excluding any transportation costs. PPB makes no warranties, indemnifications, or representations as to the health or quality of Bengal other than what is specifically named in this contract.

If Purchaser desires to make a request regarding the health guarantee, the Purchaser must immediately (within 24 hours) contact PPB with a written statement including the date when tests were performed. Purchaser must also sign a medical records release allowing Purchaser’s veterinarian to release ALL of Bengal’s records to PPB. The illness must be diagnosed by a certified veterinarian. Suspected conditions and/or inconclusive tests shall not be considered as confirmation. PPB may require a second veterinary opinion, at PPB’s expense. Failure to inform PPB within 24 hours of the veterinarian’s finding illness or other cause for concern will waive any rights to compensation, including replacement. Appropriate phone and email for contacting PPB can be found at the top of this contract.

If a replacement Bengal is required PPB is not obligated to replace the same color, gender, or pattern. Purchaser understands it may take up to a year to obtain a replacement Cat. Purchaser is responsible for all shipping/transport fees should they be required for a replacement. The original shipping fees, if any, are not refundable. PPB shall not be responsible for paying any veterinarian fees or associated costs. PPB is not liable for the effects of mishandling, mistake, or accident on the part of the buyer, or during the buyer’s possession of Bengal, whether by buyer, buyer’s agent, or third parties. Furthermore, PPB is not responsible for damage or injury to other animals, persons, or property caused directly or indirectly by Bengal.

If Purchaser declines a replacement Cat under the terms of the contract, the contract will be considered fulfilled. PPB reserves the right to refund the Purchase price minus the reservation payment rather than provide a replacement Cat to Buyer. PPB is in no way obligated to offer any monetary refunds under any circumstances, except for what is otherwise outlined in this contract.

A STATEMENT OF MINNESOTA LAW GOVERNING THE SALE OF DOGS AND CATS
The sale of dogs and cats is subject to consumer protection regulations. Minnesota law also provides safeguards to protect pet dealers and animal purchasers. Attached is a copy of Minnesota Statutes, section 325F.79. Contained within this law is a statement of your consumer rights.

3. PURCHASER RESPONSIBILITY

_______Laws & regulations

Purchaser affirms they are updated on all applicable laws and regulations regarding the ownership of Bengal. If any permits or restrictions are required it is Purchaser’s responsibility to follow all restrictions and/or obtain appropriate documentation.

_______Boarding Fee

Purchaser agrees to pick up Bengal no later than Go Home Week. If Purchaser prefers Bengal to stay with PPB longer (maximum 10 days) a written agreement must be made by Purchaser and, a rate of $25/day Boarding Fee will be charged. If Bengal is not picked up after the ten-day grace period, full ownership of Bengal shall remain with PPB and Bengal will be posted for sale, and Purchaser’s deposit forfeited. No refund will be issued.

_______Quarantine Procedure & Kitten Room

Purchaser agrees to follow proper quarantine procedures when bringing Bengal home. Proper quarantine procedures include but are not limited to physical separation from all animals in a clean quiet area, disinfection of quarantine area, hand washing between handling different animals, and provision of separate food, water, and litter accommodations for Bengal for 14 Days. This is to be sure no contagious diseases are spread and to lessen the stress put on Bengal during the transition to their new home by gradually exposing them to the sounds, smells, animals, and people within their new environment.
● PPB is not responsible for and shall not compensate Purchaser for contagious diseases or viruses transmitted between animals.

Purchaser agrees to have the room temperature set between 70°- 78°F in Bengal’s living area until Bengal is 6 months old. Colder or warmer temperatures during this critical time in a kitten’s life can lead to sickness as kittens are very susceptible to colds and infection if they are struggling to keep warm. Bengals need to be kept warmer than most cats due to the fact that Bengals have a single short tight pelt and not 2 layers of hair.

Failure to comply with all quarantine and kitten room procedures above will null and void the Health Guarantee

_______Pet Insurance

Purchaser agrees to show proof of Trupanion Pet Insurance activation before Bengal is allowed to leave PPB Cattery. if Bengal is under one year old Trupanion is provided by PPB at NO CHARGE/FREE for the first month and is highly recommended for the first year to help with any health concerns that may arise due to the stress of transitioning to a new home or insufficient kitten-proofing. This includes but is not limited to vomiting, diarrhea, weight loss, loss of appetite, swallowing plastic and needing emergency surgery…it all gets covered! There is no obligation to continue with Trupanion past the initial free month, although we really hope you do.

_______Diet

Purchaser agrees to Feed Bengal the food provided by PPB for at least the first two weeks after Go Home Day. PPB highly recommends Purchaser continue feeding Bengal a balanced raw diet or a high-quality canned food after the first two weeks. If Purchaser chooses to switch food after the two-week period, Purchaser must do so gradually in order to avoid digestive upset (taking a week or more to slowly transition). PPB’s recommendations on cat food can be found on their website in kitten care. PPB’s health guarantee does not cover any diet-related illness and therefore Purchaser should choose what they believe will result in the best health for Bengal. Ultimately it is the Purchaser’s choice what to feed Bengal, however, feeding a dry kibble diet will render PPB’s health guarantee null and void.

_______Supplement

Purchaser agrees to Purchase NuVet Immune Support daily supplement before Go Home Day and use it according to directions until Bengal is at least a year old. Purchaser must present Proof of purchase to PPB in the form of a receipt before the kittens Go Home day.Failure to do this will render PPB’s health guarantee is null and void.

● Although PPB recommends NuVet supplement for all cats, PPB believes this is especially important for kittens under 12 months old as they have immature immune systems. Kittens need all the support they can get as there are many factors that affect their condition and health such as the quality of food and environmental factors.

_______Spay/Neuter

Purchaser agrees to Spay/neuter Bengal before they turn 6 months old. Purchaser must schedule the spay/neuter appointment and inform PPB of the day, time, and place it is scheduled before Go Home Day. Purchaser must provide a veterinary certificate of spay/neuter within 3 days after surgery. Upon receipt, PPB will provide TICA Registration papers for Bengal. If proof of spay/neuter has not been received by the time Bengal is 7 months old, the intent to breed will be assumed and the Purchaser will owe PPB $2000.00 for breeding rights as well as an additional fee of $1,000 for breach of contract. This does not apply if Bengal is sold spayed/neutered or with breeding rights.

PPB recommends against administering the anesthetic Ketamine to Bengal. Isoflurane is preferred. Purchaser should discuss this issue with their veterinarian in advance of surgery.

_______Vaccinations

Purchaser is responsible for vaccinations and maintaining current vaccinations for Bengal. PPB recommends seeking the advice of a licensed board-certified veterinarian for Bengal’s health and well-being. PPB recommends the use of non-adjuvant vaccines and/or intranasal vaccines to reduce the risk of vaccine-related sarcoma. PPB supports Titer Tests for FVRCP (Feline Viral Rhinotracheitis, Feline Calicivirus, Feline panleukopenia). If needed The ONLY Vaccinations PPB recommends are the yearly then every 3-year FVRCP vaccine. PPB recommends Purchaser discuss with a veterinarian the disease risk in their individual situation. PPB recommends that Purchaser remains informed on further developments on vaccines and technology. PPB does not assume any responsibility for ANY vaccine-related injury OR vaccine-preventable illness.

Rabies vaccination is left to Purchaser’s discretion, and to the requirements of Purchaser’s country, state, and local regulations. It is Purchaser’s responsibility to comply with all regulations involving the rabies vaccine. PPB recommends the use of non-adjuvant vaccines (such as the PureVax brand) whenever possible. PPB notes that according to the National Institutes of Health “vaccination against rabies and feline leukemia virus is perhaps the most common inciting cause (of Feline injection-site sarcomas)”.

_______Health and Well-being

Purchaser agrees to provide Bengal with a lifetime commitment to their care, including, but not limited to love, respect, responsible care, all necessary veterinary care, preventative veterinary care, a clean environment, proper nutrition and water, grooming, and human love and attention. If illness, distress, or injury occurs, Purchaser must provide Bengal with immediate veterinarian care and all prescribed treatment is to be followed. Failure to do so will render the health guarantee null and void. PPB has the right to at any time have the Bengal examined by a veterinarian of PPB’s choosing at PPB’s expense.

Purchaser agrees that if at any time Bengal is found to be malnourished, abused, neglected, or kept in poor conditions the health guarantee will be rendered null and void and Purchaser shall unconditionally surrender possession of Bengal to PPB, or a PPB-authorized agent. All veterinarian fees and transportation will be the sole responsibility of Purchaser. No refund or other compensation will be made.

Purchaser agrees to never de-claw and/or de-meow Bengal. If Bengal is found to be subjected to any type of de-claw and/or de-meow procedure the health guarantee will be null and void.

Bengal will only be allowed outdoors under strict supervision wearing a harness & leash or in an enclosed carrier or catio. PPB’s health guarantee does not cover any health issues that could be a result of outdoor exposure.

_______Re-home & Euthanasia

If at any time the Purchaser decides to sell/re-home Bengal, PPB must be notified. PPB has the first right to purchase Bengal back at half the original Purchase price minus the cost of transportation. Bengal cannot be returned if exposed to another cat without FeLV and FIV testing within a month of exposure. Should Bengal be returned to PPB, Purchaser Must Have a veterinarian check-up within 5 days before return, including tests for FeLV and FIV. Snap FeLV and FIV tests can result in false positives, so if Bengal gets a positive result, Purchaser must isolate Bengal and retest 30 days later. Bengal cannot be returned if they test positive for FeLV or FIV after retesting. If Bengal tests negative for FeLV and FIV, Purchaser must sign a medical records release allowing Purchaser’s veterinarian to release ALL of Bengal’s records to PPB. Once returned, Bengal shall revert to PPB’s sole ownership. Buyer is responsible for timely cooperation in completing, signing, and forwarding to Seller all paperwork necessary for re-registration of Bengal. Once Bengal and all paperwork and tests are in PPB’s possession PPB has 5 days to pay Purchaser for Bengal.

Purchaser may rehome Bengal to a third party only with the written consent of PPB. If Purchaser sells/gives Bengal to a third party, the health guarantee is Null and Void, however, the spay/neuter agreement is still applicable. Under no circumstances will Bengal be sold, leased, or given away to any pet shop, animal shelter, research laboratory, or similar facility. If Bengal has been rehomed without written permission of PPB or placed in the above-mentioned places Purchaser must immediately authorize the third party to release Bengal to PPB upon request and pay a $2500 penalty to PPB Plus recoup PPB for whatever the amount required for PPB to regain custody of Bengal from the third party including transportation.

Purchaser agrees to contact PPB within 3 hours If a veterinarian determines Bengal to be seriously ill. Furthermore, Purchaser must contact PPB if Euthanasia is mentioned as an option by a Veterinarian for Bengal. Purchaser cannot euthanize without first offering Bengal to PPB. If PPB requests the return of Bengal, PPB is responsible for all transportation. Purchaser must sign a medical records release allowing Purchaser’s veterinarian to release ALL of Bengal’s records to PPB. Once returned, Bengal shall revert to PPB’s sole ownership. Purchaser is responsible for timely cooperation in completing, signing, and forwarding to Seller all paperwork necessary for re-registration of Bengal. No refund or other compensation will be made.

Should Bengal pass away PPB must be contacted within 3 hours of Bengal’s passing. If a Necropsy is performed Purchaser agrees to send results to PPB. If Purchaser refuses their right to perform a necropsy PPB has the option to have a necropsy at PPB’s expense. The Health guarantee is null and void if Purchaser refuses their right to a necropsy.

4. PPB’s GUARANTEE

PPB guarantees that Bengal is purebred and eligible for registration with The International Cat Association (TICA). Purchaser will have the option to change Bengal’s name after Pick Up Day and at the time of registration with TICA. PPB provides TICA Registration papers after proof of spay/neuter is sent to PPB. It is the responsibility of the Purchaser to complete and submit the TICA registration papers, and for paying the registration fee.

PPB guarantees Purchaser will receive all Bengal’s Health records and documents on Go Home Day, including but not limited to vaccinations, wormings, and any Procedure information

PPB Guarantees Bengal is not at risk of PRA-b and PKDef by genetic testing of parents. According to PPB’s present knowledge and concurrent with recent veterinary exams, all health concerns, if any, have been disclosed. Bengal is free of genetic defects and/or congenital diseases. Bengal has been wormed and is vaccinated against feline panleukopenia, rhinotracheitis, and calicivirus. PPB guarantees Bengal is negative for Feline Leukemia (FeLV) and Feline Immunodeficiency Virus (FIV) at the time when transferred to Purchaser. Bengal’s parents and all other cats owned by PPB have tested negative for FeLV and FIV and Bengal has never been exposed to any untested cats.

_______3-Year Congenital Defect Guarantee

PPB guarantees that to the best of their knowledge, Bengal is free of the congenital defects listed below. Should Bengal die as a result of one of these congenital defects before the age of 3, Bengal will be replaced. an appropriate necropsy must be performed by a licensed vet and the necropsy report provided to PPB proving the cause of death was one of the congenital defects listed below. (see limits of liability for information on replacement Bengals)

_______72-Hour Health Guarantee

Purchaser agrees to have a licensed Veterinarian examine Bengal within 3 days (72 hours) of Go Home Day. If within this time, Purchaser’s veterinarian finds Bengal to have any serious defect or life-threatening condition, Purchaser may choose to return Bengal for replacement (see limits of liability for information on replacement Bengals). No vaccines or surgeries including spay/neuter may be administered during this appointment. A separate appointment must be scheduled no earlier than 2 weeks after Go Home Day if surgery or Vaccines are needed/wanted. Failure to comply will null and void the Health Guarantee. PPB won’t send any Bengal to a new home without first disclosing all known health issues; however, this clause protects the Purchaser in case PPB’s vet has missed something.

Why a 72-Hour Vet Vist? This allows your vet to establish a baseline of what your Bengal looks like when healthy. A great deal of stress happens within the first month of a kitten’s transition into their new home including but not limited to transport, a new home, no more littermates or mom, and a possible diet change, or other animals. This can quickly lead to stress-related issues such as diarrhea or loss of appetite. For this reason, you must be able to bring your kitten to an already-established vet you trust where your Bengal is not a “new” patient.
Many vets book up weeks to months in advance so please take the time NOW to make that first vet appointment within the 72-hour window.

_______14-Month FIP Guarantee

While there is NO way PPB can predict or prevent the occurrence of FIP, PPB offers a conditional replacement guarantee until Bengal is 14 months. If Bengal is diagnosed with FIP, Purchaser must inform PPB within 12 hours and start treatment with GS-441524 within 48 hours. If Bengal is successfully cured of FIP, PPB will refund 50% of the purchase price.

Should Bengal die of FIP before the age of 14 months despite treatment, Bengal will be replaced if an appropriate necropsy is performed by a licensed vet and the necropsy report is provided to PPB proving the cause of death was FIP. (see limits of liability for more information on replacement Bengals)

If Purchaser is unable/unwilling to treat, Bengal must be returned to PPB for treatment within 48 hours of diagnosis. Once Bengal is returned with a signed transfer of ownership and the steps have been taken in the Limits of Liability PPB will refund 50% of the purchase price.

_______5-Year Hypertrophic Cardiomyopathy (HCM) Guarantee

PPB guarantees that to the best of their knowledge, Bengal is free of hypertrophic cardiomyopathy (HCM) on the date of purchase. Bengal’s parents have been determined to be free of any signs of HCM by a heart scan performed by a board-certified cardiologist within 18 months prior to the purchase of Bengal. At the present time, there is no genetic test for HCM for Bengals. Unfortunately, heart problems are not easily detected in kittens and may only be detected when the cat is several years old.

If Bengal is diagnosed with HCM by An echocardiogram report from a board-certified cardiologist before 3 years of age purchaser must treat Bengal with the medication suggested by their veterinarian and follow all prescribed treatments. In this case, PPB will offer a replacement Bengal upon Bengal’s death, regardless of age. (see limits of liability for more information on replacement Bengals)

If Bengal is not diagnosed before age 3 but dies before age 5 of suspected HCM, a necropsy must be performed by a licensed vet. Purchaser must provide PPB with the necropsy report proving the cause of death was HCM, PPB will offer a 50% discount on a replacement kitten. (see limits of liability for more information on replacement Bengals)

5. Breeder Specific

_______If Bengal is purchased as a breeder male, PPB highly recommends not using Bengal for outside stud service. PPB highly recommends any queen bred by this stud and all subsequent litters be owned entirely by Purchaser. If Purchaser chooses to offer outside stud service PPB highly recommends health testing to any potential partners. These tests include Feline panleukopenia virus, Tritrichomonas, Giardia screen, Feline leukemia virus (FeLV), Feline immunodeficiency virus (FIV), Feline calicivirus (FCV), Feline herpes virus. Purchaser agrees that offering outside stud service will null and void the health guarantee. Once Bengal is no longer needed, he is to be Neutered and allowed to live out the rest of his days as a spoiled pet. Bengal cannot be resold as an intact Stud.

_______If Bengal is purchased as a breeder female, PPB highly recommends not obtaining outside stud service. PPB highly recommends any stud that is bred to Bengal and all subsequent litters be owned entirely by Purchaser. If Purchaser chooses to receive outside stud service PPB highly recommends health testing of any potential partners. These tests include Feline panleukopenia virus, Tritrichomonas, Giardia screen, Feline leukemia virus (FeLV), Feline immunodeficiency virus (FIV), Feline calicivirus (FCV), and Feline herpes virus. Purchaser agrees that obtaining outside stud service will null and void the health guarantee. Once Bengal is no longer needed, she is to be Spayed and allowed to live out the rest of her days as a spoiled pet. Bengal cannot be resold as an intact Queen.

_______Purchaser agrees none of Bengal’s kittens will be sold to animal brokers, pet shops, their agents, or sold in “litter lots”. All kittens will be sold with registration papers and health guarantee. Purchaser takes full responsibility for the well-being of all kittens produced/sired by Bengal.

_______Due to the many factors involved in rearing and caring for Bengal that are beyond the control of the PPB, there are no guarantees on fertility or temperament. There are no guarantees given on future show achievements or reproduction capabilities of Bengal. There is no guarantee against pyometra. There are no guarantees against lockets or tail faults. PPB verifies there are no precluding reasons why Bengal should be unable to produce/sire normal litters. The process of breeding is not to be taken lightly, therefore, breeders must take measures to educate themselves on the subject.

  • By making a payment to PPB Purchaser acknowledges they have read, understand, and agree to Pet Perfect Bengal’s Sales Contract. Neither Party shall have the right to modify this contract except by mutual agreement. Changes and additions must be made in writing, initialed, and dated by both Parties. This contract is the entire agreement between PPB and Purchaser pertaining to Bengal. It supersedes all prior agreements and understandings, either oral or written. This contract applies to both Parties listed below. Once payment is made Pet Perfect Bengal’s Sales Contract is legally binding.
